Waiver and Release of Liability

Please Read Carefully Before Signing.
This is a release of liability and waiver of certain legal rights.

In consideration of Participant’s use of property, facilities, and services of Midwest Pickleball Club LLC ("MPC"), the undersigned (Participant or Parent/Guardian) agrees to release, waive, and discharge MPC and its affiliates from liability related to:

  • Personal injury or death arising from participation in MPC activities.
  • Property damage, loss, or theft.
  • Unauthorized access to Club property.

Indemnification and Hold Harmless

Participant and/or Parent/Guardian agree to indemnify MPC from all claims, damages, or legal fees unless caused by gross negligence by MPC.

Severability and Venue

This waiver is governed by Nebraska law. If any part is found invalid, the rest remains in effect.

Acknowledgment of Understanding

Participant/Guardian acknowledges full understanding and acceptance of all terms in this waiver and agrees to its binding nature.

Assumption of Risks

Participation in MPC activities (e.g., pickleball, fitness classes) involves inherent physical risks including:

  • Minor: bruises, sprains, cuts.
  • Major: broken bones, heart attacks.
  • Catastrophic: paralysis, death.
  • Exposure to contagious diseases (e.g., COVID-19).

Participation is voluntary, and all risks are assumed by the Participant and/or Parent/Guardian.

Rules and Standards of Conduct

Participants must follow all MPC rules outlined in the Member Agreement and by staff instruction. Non-compliance may result in suspension or termination of membership.

Image Release

Participant/Guardian consents to the use of photos/videos taken at MPC for promotional purposes without compensation.

Agreement to Participate

Acknowledgment that participation assumes inherent risks, and Participant releases MPC from related liabilities.

Non-Compete Clause

Members and guests may not offer or accept payment for services or goods that compete with MPC while on the premises.

Risk Disclaimer

Facility use is at the Member’s and guest’s own risk. MPC is not liable for lost/stolen items. Lockers are available at personal risk.

Lost and Found Policy

Items left will be kept for 7 days at the front desk. Unclaimed items may be discarded or donated thereafter.

Pro Shop Return/Exchange Policy

  • 15-day return window with receipt and unused product.
  • Excludes: lessons, clinics, leagues, guest fees, and membership dues.
  • All memberships are non-refundable and non-transferable.

Club Rules

MPC reserves the right to update rules. All Members and guests must:

  • Comply with Club Rules (available at Club).
  • Understand that only Club staff enforces rules.
  • Accept that failure to enforce a rule doesn’t waive future enforcement.

Consequences: May include warnings, suspension, or permanent ban.

Court Reservation Cancellation Policy

Cancel reservations with 24-hour notice to avoid forfeiting fees.

Guest Policy

Non-members must pay a guest fee or use a member's guest pass. Violation may lead to suspension.

Reservation System

Members are expected to act in good faith and not game the system. Abusing the reservation process may result in disciplinary action.

Attire Guidelines

  • Non-marking court shoes only.
  • Shirts and proper footwear required at all times.

Code of Conduct

  • No profanity, threats, or harassment.
  • Be respectful and kind.
  • Violations may result in termination without refund.

Property Damage

Members and guests are responsible for damage caused by negligence or intentional acts.

Theft

Theft will result in police involvement and immediate termination of membership without refund.

Harassment Policy

Harassment of any kind will not be tolerated.

Food and Drink

No outside food or drink allowed. Not permitted on courts.

Drug Policy

No smoking, vaping, or illegal substances on Club property.

No Pets Policy

Only legally required service animals are allowed.

Electronic Acceptance

By checking the box, the Member agrees to all terms and waives related liabilities.

  • Auto-renews at $99.99/month

  • $25 due at sign-up
  • Monthly billing begins after 30 days

5. Termination Policy

  • Can terminate with notice after 30 days
  • No refunds for unused portions

6. Conduct Policy

  • Members must follow Club rules

7. Liability Waiver

  • Participation assumes risk
  • MPC not liable for injury or loss

8. Modifications

  • Club may change terms with notice

9. Legal Jurisdiction

  • Governed by Nebraska law

    • 5 simultaneous bookings

Membership Termination & Cancellation

7.1 Month-to-Month

  • 30-day written notice required
  • No refunds for partial months
  • Club may terminate for rule violation or non-payment

7.2 12-Month Commitment

  • Member responsible for all months, even if cancelled
  • Club may terminate for violations
  • Limited refund for cancelled programs/camps
  • No refund for missed events

Governing Law & Dispute Resolution

  • Governed by Nebraska law
  • Disputes settled via mediation/arbitration
  • No jury trial
